Please read these terms carefully before using the MonthlyTag platform

1.

Acceptance of Terms

By accessing, browsing, or using the MonthlyTag platform (the "Platform"), operated by MonthlyTag, LLC ("MonthlyTag," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, and our Taxes and Fees Policy. If you do not agree to these Terms, you must not access or use the Platform. MonthlyTag reserves the right to modify these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

Platform Overview

MonthlyTag is an online platform that connects individuals and businesses seeking monthly parking ("Customers") with independent third-party parking facility owners, partners, and property managers ("Partners") who list available parking spaces. MonthlyTag does not own, operate, lease, or manage any parking facilities listed on the Platform.

MonthlyTag serves solely as an intermediary that facilitates the discovery, reservation, and payment of monthly parking spaces. All parking services are provided exclusively by Partners, and any contractual relationship regarding parking is between the Customer and the Partner.

3.

Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use the Platform. By creating an account, you represent and warrant that all registration information you submit is truthful, accurate, and complete, and that you will maintain the accuracy of such information.

Accounts are for individual use only unless you register as a corporate Customer, in which case the authorized representative agrees to these Terms on behalf of the organization.

4.

User Accounts

The Platform supports the following account types:

  • Customers (Individual or Corporate): Users who search for, browse, and book monthly parking spaces. Individual Customers provide personal and vehicle information. Corporate Customers provide company details and a designated contact person.
  • Partners (Individual, Corporate, or Government): Parking facility owners or partners who list available parking spaces, manage reservations, view revenue reports, and oversee their facilities through the Platform.
  • Managers: Individuals invited by Partners to manage one or more parking facilities on the Partner's behalf. Managers can view customer bookings, scan QR codes to verify customer details, and manage day-to-day facility operations.

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify MonthlyTag immediately of any unauthorized use of your account. MonthlyTag is not liable for any loss arising from unauthorized use of your account.

5.

Booking and Reservations

Customers may search for parking facilities by location, view availability, and reserve monthly parking spaces through the Platform. Upon completing a booking, the Customer enters into a direct arrangement with the Partner for the use of the parking space.

All bookings are subject to the availability of spaces at the selected facility and the Partner's acceptance. MonthlyTag does not guarantee the availability of any specific parking space or facility.

  • Regular Parking: Standard monthly parking in available spaces at the facility.
  • Reserved Spot: A designated parking space reserved specifically for the Customer at an additional rate set by the Partner.

By completing a booking, you agree to comply with all rules, regulations, and policies of the parking facility as set forth by the Partner.

6.

Payments and Billing

Customers are billed on a monthly basis. Payment is due on the 1st of each month. Customers who opt for automatic renewal will have their payment method charged automatically. Customers who choose manual payment will receive a monthly invoice and must remit payment by the 5th of each month.

If payment is not received by the 5th of the month, the Customer's parking access may be suspended. Failed payments may be retried on the 3rd of the month. If payment remains unpaid past the 5th, the booking may be cancelled. Cancelled bookings may be reinstated within 90 days, subject to availability.

All payments are processed through Stripe, our third-party payment processor. MonthlyTag does not store complete credit card numbers. The MonthlyTag Service Fee includes all payment processing costs — no separate processing fees are charged to Customers. Please refer to our Taxes and Fees Policy for details about service fees and tax responsibilities.

7.

Refund Policy

All sales made through MonthlyTag are final. There are no refunds for payments made through the Platform, including but not limited to parking fees, service fees, or any additional charges. Once a transaction is completed, no part of the payment is refundable under any circumstances. Proration may apply for bookings made after the 15th of a month, at MonthlyTag's discretion.

8.

Partner Obligations

Partners who list parking facilities on the Platform agree to the following:

  • Provide accurate and up-to-date information about their facilities, including address, available spaces, pricing, and operating hours.
  • Maintain their facilities in a safe, clean, and lawful condition.
  • Honor all confirmed reservations made through the Platform.
  • Comply with all applicable federal, state, and local laws and regulations, including tax obligations.
  • Complete Stripe payment onboarding to receive payouts. Partners may not create or list facilities on the Platform until their payment account setup is complete.
  • Not engage in discriminatory practices against any Customer.

MonthlyTag reserves the right to remove any facility listing or suspend any Partner account that violates these Terms or engages in fraudulent, misleading, or unlawful activity.

9.

Manager Responsibilities

Managers are appointed by Partners to oversee daily operations at one or more parking facilities. A single Manager may be assigned to multiple facilities belonging to the same Partner, and a single facility may have multiple Managers.

Managers may view booking details, scan Customer QR codes to verify identity and reservation status, and perform other operational tasks as delegated by the Partner. Managers must handle all Customer information in accordance with our Privacy Policy and applicable data protection laws.

10.

Customer Information and QR Codes

Each Customer with an active booking is assigned a unique MonthlyTag location number and a QR code. When scanned by an authorized Manager, the QR code displays the following information:

  • Partner name and facility address
  • MonthlyTag location number
  • Reservation type (Reserved or Regular) and booking status (Active or Inactive)
  • Customer type (Individual or Corporate)
  • For Individual Customers: name, email, contact number, vehicle make, color, and plate number
  • For Corporate Customers: company name, contact person, contact number, and email

This information is displayed solely for the purpose of verifying parking authorization and must not be used for any other purpose.

11.

Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, icons, images, software, and the arrangement thereof, is the property of MonthlyTag, LLC or its licensors and is protected by United States and international intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Platform without the prior written consent of MonthlyTag.

12.

Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Interfere with or disrupt the operation of the Platform or servers or networks connected to the Platform.
  • Attempt to gain unauthorized access to any portion of the Platform, other accounts, or any systems or networks connected to the Platform.
  • Use any automated means (including bots, scrapers, or spiders) to access or collect data from the Platform.
  • Post or transmit any content that is defamatory, obscene, fraudulent, or otherwise objectionable.
  • Use another User's account without authorization.
  • Circumvent, disable, or otherwise interfere with any security-related features of the Platform.
13.

Disclaimer of Warranties

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

MonthlyTag does not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. MonthlyTag does not warrant the accuracy, completeness, or reliability of any content on the Platform, including facility listings, pricing, or availability information provided by Partners.

14.

Limitation of Liability

To the fullest extent permitted by applicable law, MonthlyTag, LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Platform, regardless of the theory of liability.

MonthlyTag is not responsible for any damage to vehicles, personal property, or personal injury occurring at any parking facility listed on the Platform. All parking is at the Customer's own risk. Partners are solely responsible for the safety and condition of their facilities.

In no event shall MonthlyTag's total aggregate liability exceed the amount of service fees paid by you to MonthlyTag in the twelve (12) months preceding the event giving rise to the claim.

15.

Indemnification

You agree to indemnify, defend, and hold harmless MonthlyTag, LLC, and its affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit or transmit through the Platform.

16.

Privacy

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection, use, and sharing of your information as described in the Privacy Policy. Please review our Privacy Policy for details on how we handle your personal data.

17.

Account Termination

MonthlyTag reserves the right to suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent activity, non-payment, or conduct that MonthlyTag determines to be harmful to other Users or the Platform.

Upon termination, your right to use the Platform will immediately cease. Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership, warranty disclaimers, indemnification, and limitations of liability.

18.

Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Platform shall first be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue binding arbitration in accordance with the rules of the American Arbitration Association.

Any arbitration or legal proceeding shall take place in Montgomery County, Maryland. You agree to submit to the exclusive jurisdiction of the courts located in Maryland for any legal proceedings that are not subject to arbitration.

19.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Maryland.

20.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall continue in full force and effect.

21.

Entire Agreement

These Terms, together with the Privacy Policy and the Taxes and Fees Policy, constitute the entire agreement between you and MonthlyTag regarding your use of the Platform and supersede all prior agreements, understandings, and communications, whether written or oral, regarding the subject matter herein.

Important Notice

By using MonthlyTag, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These Terms should be read in conjunction with our Privacy Policy and Taxes and Fees Policy.
